DMCA COPYRIGHT POLICY

Effective Date: December 15, 2025

Gruby respects the intellectual property rights of others and expects our users to do the same. This policy explains how we respond to claims of copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable laws.

1. OUR POLICY

It is our policy to:

  • Respond promptly to notices of alleged copyright infringement
  • Remove or disable access to material that is claimed to be infringing
  • Terminate the accounts of repeat infringers in appropriate circumstances

2. FILING A COPYRIGHT INFRINGEMENT NOTICE

If you believe that content on Gruby infringes your copyright, you may submit a DMCA takedown notice to our designated Copyright Agent. Your notice must include the following information:

2.1 Required Information

  • Identification of the copyrighted work: Describe the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
  • Identification of the infringing material: Provide the URL or other specific location of the material you claim is infringing, with sufficient detail for us to locate it.
  • Your contact information: Include your name, address, telephone number, and email address.
  • Good faith statement: Include a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • Accuracy statement: Include a statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  • Physical or electronic signature: Include your physical or electronic signature.

2.2 Where to Send Notice

3. COUNTER-NOTIFICATION

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our Copyright Agent.

3.1 Required Information

Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the US, any judicial district in which Gruby may be found)
  • A statement that you will accept service of process from the person who filed the original DMCA notice or their agent

3.2 Counter-Notification Process

Upon receiving a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If that party does not file a court action seeking an order to restrain you from engaging in the allegedly infringing activity within 10-14 business days, we may restore the removed content.

4. REPEAT INFRINGER POLICY

Gruby will terminate the accounts of users who are repeat infringers in appropriate circumstances. A "repeat infringer" is a user who has been notified of infringing activity more than twice or whose content has been removed from the Service more than twice.

We reserve the right to terminate accounts in our sole discretion, including accounts that have received only one notice of infringement if the circumstances warrant.

5. RECIPE COPYRIGHT CONSIDERATIONS

Important note about recipes and copyright:

  • Ingredients lists are generally not copyrightable (copyright law protects the expression, not the facts or ideas)
  • Instructions and descriptions can be copyrighted if they contain creative expression
  • Photos and videos are copyrightable and should not be used without permission
  • Exact copying of entire recipes (including instructions and descriptions) from cookbooks or websites may infringe copyright

When sharing recipes, we encourage you to:

  • Use your own words to describe the recipe
  • Take your own photos and videos
  • Give credit and attribution when inspired by someone else's work
  • Seek permission before posting substantial portions of copyrighted recipes

6. FALSE CLAIMS

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability. We reserve the right to seek damages from any party who submits a notice or counter-notification in bad faith.

7. MODIFICATIONS TO POLICY

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Service constitutes acceptance of any changes.
